OPENROADS RALLY VOLUNTEER CONDITIONS OF SERVICE

“OpenRoads” , “us” , “we” , “our” refer to OpenRoads Group PTY LTD (ACN 32660507951). When you submit an online application to volunteer with Us, you are agreeing to the Terms and Conditions listed below. 

By applying to volunteer with OpenRoads you agree to the following terms: 

Engagement
You will be assigned activities designated by OpenRoads staff “Volunteer Activities” for the agreed number of hours as detailed in Schedule 1. We will endeavour to assign you activities as per your preference selected in the volunteer application form. However, at times you may be asked to assist with other tasks you have not selected. OpenRoads and its staff promise not to ask you to engage in activities that you do not have the licence or skill for, such as sweep riding, first aid, service of alcoholic beverages or food handling.

Volunteer duties and responsibilities
The Volunteer agrees to, as far as is reasonably practicable, accept all reasonable and lawful direction in relation to the Volunteer Services from OpenRoads staff (such as directors, employees and volunteers with a leadership role).

(a) The Volunteer acknowledges that:

(i) the Volunteer is not entitled to the payment of any remuneration with respect to the Volunteer Services provided to OpenRoads

(ii) the Volunteer is not entitled to the benefit of any statutory entitlements applicable to any employee of the OpenRoads, such as annual leave, personal leave or long service leave; and

(iii) the Volunteer is not under any obligation to provide the Volunteer Services for the OpenRoads at any particular time, or at all.

(b) The Volunteer undertakes that, whenever providing the Volunteer Services to OpenRoads, the Volunteer will:

(i) perform any activities assigned;
(ii) comply with all reasonable directions given by the OpenRoads; and
(iii) act, at all times, in accordance with the aims and objectives of the OpenRoads, and the Volunteer’s own common sense, where it is not possible to obtain prior authority.

Authority
Except when expressly authorised to act as such, the Volunteer is not the agent or representative of the OpenRoads in any way, nor does the Volunteer have any authority or right to assume any obligation of any kind on the OpenRoads’s behalf, nor to bind or commit the OpenRoads in any way.

Any matter requiring the authorisation of, or permission from, OpenRoads, the Volunteer may only be validly authorised or permitted in writing by a person to whom express authority is granted.

Expenses
The Volunteer is not entitled to a salary, gratuity or other payment.

The Volunteer’s reasonable expenses, incurred as a result of providing the Volunteer Services, if any, may be reimbursed at the discretion of the OpenRoads. Any claim for reimbursement must be supported by receipts or other evidence of actual payment as the OpenRoads may reasonably require.

Some benefits are provided as part of the Volunteer Tier - as detailed in Schedule 1

Health and Safety
OpenRoads is under a duty to ensure, as far as reasonably practicable, the health, safety and welfare of all employees and other persons (including volunteers and members of the public) who are affected by its activities.

The Volunteer agrees to cooperate fully with the OpenRoads’s health and safety policies to enable the OpenRoads to perform any duty or comply with any requirement imposed by law.

The Volunteer agrees:
(a) to take reasonable care for the health and safety of all persons who may be affected by the Volunteer’s acts or omissions, including the Volunteer;to read all health and safety notices posted for volunteer staff;
(b) to be fully aware of the health and safety hazards associated with performing the Volunteer Services;
(c) to perform the Volunteer Services safely and efficiently;
(d) not to do anything which may injure any person or expose any person to risk;
(e) to make full and proper use of all safety and protective equipment and clothing;
(f) to adhere to all procedures specified by the OpenRoads or any instructions issued with any plant, machinery or substance used; and
(g) to report to management any actual or potentially unsafe conditions, systems of work, buildings, vehicles, plant or other equipment.

Personal Risks
The volunteer acknowledges and accepts the responsibilities and risks associated with their agreement to travel to, temporarily stay at and provide Volunteer Services in remote locations. 

Such travel and volunteer work can be often hazardous and involves a certain degree of risk, inherently dangerous activities and personal perils to the volunteer, both foreseen and unforeseen, all of which are fully accepted by and solely assumed by the volunteer. Therefore, OpenRoads including any and all of its employees, managers, directors, shareholders and partners are not liable, to the maximum extent of the law, for any loss or harm the volunteer or associates may suffer, including but not limited to loss caused by: Personal injury, Accommodation, Transportation, Safety, Hygiene, Civil Unrest, Dangers associated with wild or other animals, High Altitude, Food, Water, Emotional injury, Death, Illness or disease, War or Act of Terrorism, Damage to or loss of property, Accident or illness in remote regions without means of rapid evacuation or availability of medical supplies and facilities, Adequacy of medical attention once provided, and outbreaks of disease.

You accept and acknowledge and confirm that personal injury or illness, emotional trauma, property damage and death can occur by natural causes or activities of persons or animals, either as a result of negligence or because of other reasons.

By applying to volunteer with Us online you confirm that you have read and agree to these terms & conditions and to the maximum extent permitted by law, you are waiving us of any Liability that, amongst other things forever releases us, our owners, our directors, our shareholders, our employees and any persons or groups associated to us of all liability related to:

(a) Forever releases us, our owners, our directors, our shareholders, our employees and any persons or groups associated to us of all liability;
(b) Forever signifies that you are waiving any claims against us, our owners, our directors, our shareholders, our employees and any persons or groups associated with us, and expressly assuming all risks associated with participating in any of our events.

Travel
OpenRoads does not arrange travel arrangements to the event location. It is your own responsibility to arrange your own travel to the event location. 

Fees and refunds
Volunteer tickets are refundable minus an admin fee (1.75% + A$0.30 for debit and credit card transactions, and 2.6% + A$.30 for PayPal transactions) up to sixty days before the event start date. There are no exchanges available for volunteer tickets.

Refund requests must be received no later than sixty days prior to the event start date through written confirmation via email. Upon receipt of the request the volunteer will be notified immediately via email. If the volunteer does not receive confirmation they should assume that the request has not been received. 

Under the rare instance where OpenRoads is not able to accept you as a volunteer,  we will refund you discounted ticket less an admin fee.

Event Fee
You will find the volunteer ticket costs in schedule 1. OpenRoads reserves the right to change the ticket costs anytime without any prior information. All ticket costs are due 7 days from the event start date, if you fail to make your payment before this time OpenRoads has the right to cancel your volunteering.

Use of Photos and Feedback
By agreeing to the terms and conditions you agree that OpenRoads can use your photos and written feedback while at the event to post on its website www.openroadsrally.com. OpenRoads might use such material for marketing/promotion in form of brochure/emails/social media or on any of its websites. OpenRoads also uses photos and material from our partners and is not responsible for claims arising towards that material/photos/content. This includes photos and videos posted on our Facebook page and other social media network sites.

Under 18 Volunteers
Volunteers who decide to participate in our events who are under 18 at the time of starting the event “Under 18 Volunteer”, need to provide us with a Parental/Guardian consent in writing.

The Under 18 Volunteer and their parent/guardian each acknowledge that whilst volunteering at one of our events, it is the Under 18 Volunteer’s responsibility to make all reasonable efforts to avoid any activity, environment, object or substance that may have an adverse effect on the Volunteer’s health or well-being.

To the maximum extent permitted by law, the Under 18 Volunteer and their parent/guardian release OpenRoads (including all employees, shareholders and partner OpenRoads) from any claim, suit, action or proceeding in respect of the removal, and/or entering, of the Under 18 Volunteer from or into the event in accordance with this Agreement.

Code of Conduct
OpenRoads is a responsible OpenRoads and is committed to ensuring good environmental practices. Any breaches of the Code of Conduct may result in your placement being terminated without any refund.

(a) I agree that I will not hold OpenRoads (including all employees, shareholders and partner OpenRoads) liable for any loss or harm I may suffer including loss caused directly or indirectly by personal injury, emotional injury, death, illness or disease, damage to or loss of property.

(b) I agree that I have declared any medical/mental health conditions or physical limitations which may affect my ability to fully partake in the overall experience.

(c) I acknowledge that OpenRoads will do their best to cater for dietary requirements, but ultimately, I am responsible for communicating any dietary requirements to OpenRoads and recognising if and when I may need to bring/purchase individual ingredients at my own expense to ensure I police my own requirements.

(d) I agree that I am responsible for my own safety and wellbeing outside of volunteering hours and duties, or when not undertaking voluntary work and will manage any accidents or incidents that may occur in this time.

(e) I agree that I will not drink excessive levels of alcohol that could impede my overall judgement and safety. OpenRoads has a zero-tolerance policy towards the possession and use of illegal substances and will result in instant termination.

(f) I acknowledge any breach of the Code of Conduct can result in potential disciplinary action and ultimately termination of the volunteer contract with no refund or onward support applicable. Should I choose to leave the event early for whatever reason then OpenRoads are not liable for any refunds for unused time/expenses for onward costs.

General Code of Conduct
I agree to:

(a) Maintain a positive and proactive approach through my experience.
(b) Follow the event schedule provided by project staff
(c) Assess the risks of every activity I am involved in and seek further advice or guidance if in doubt
(d) Inform the team of any medical issues, which may arise during my time at the event
(e) Be aware that there are no refunds if I decide to leave early.
(f) Maintain high levels of hygiene and cleanliness at all times.
(g) Be vigilant with my possessions and use safes/lockers to store any valuables where appropriate and will not hold OpenRoads responsible for any losses incurred.
(h)Respect the event policy on the consumption or possession of alcohol.
(i) Abide by any curfews within the volunteer accommodation.
(j) Not consume alcohol in the event I am under the legal drinking age
(k) OpenRoads has the right to cancel any placement of an enrolled volunteer if the above code of conduct is violated.

Confidentiality
By agreeing to the terms and conditions you agree to keep all information relating to OpenRoads (including its finances, membership and activities) confidential and not to use or disclose the information except as authorised or as required to perform the Volunteer Services.

You acknowledge that all records in any medium (whether written, digital or otherwise) including accounts, documents, drawings and private notes about OpenRoads and its activities, and all copies and extracts of them made or acquired by you in the course of the Volunteer Services:

(a) are the property of OpenRoads;
(b) must be used for OpenRoads' purpose only; and
(c) must be returned to OpenRoads at any time on demand.

Legal Binding
These Terms set out by OpenRoads shall be legally binding upon you, your family, administrators, executors and legal representatives. In accepting this document & by applying to volunteer with Us, you are not relying upon any oral or written representations or statements made by us other than what is set forth in these Terms. 

Victorian law and jurisdiction 
These Terms shall be created, performed, interpreted and enforced in accordance with the laws applicable in Victoria, Australia and the parties submit to the non exclusive jurisdiction of the courts of that place.
